Florida Grubhub driver upset over Burger King order started swinging a large ashtray, police say. - Tampa Bay Times

A Tampa Bay area Grubhub driver was arrested over the weekend after he picked up a large ashtray and swung it at a Burger King employee because he didn’t think his delivery order was done quickly enough, police reports state.

Daniel Delellis, 43, of Clearwater, faces two charges of simple battery in connection with the incident, which occurred about 5:20 p.m. on Saturday at the Burger King at 2765 Gulf to Bay Blvd.

Arrest reports say Delellis walked into the Burger King to pick up an order for delivery. He became agitated when told the order wasn’t ready yet. He “walked outside and picked up an approximately 3 foot in height hard plastic cigarette ash tray and swung it at the front doors,” arrest reports state.

A Burger King employee stepped outside and told Delellis to leave, at which point Delellis hit him in the face with his hand, reports state. He also swung the ashtray at another employee, hitting him in the chest, reports state.

Police were called and Delellis was arrested. Bail was set at $1,000. Delellis was being held at the Pinellas County jail on Monday.

Delellis also is awaiting trial on other charges related to an incident that occurred on Oct. 30 when he began yelling at another driver while on U.S. 19 in the Tarpon Springs area. Delellis cut the driver off, struck his left bumper, then got out of his car and started jumping on the hood of the other driver’s vehicle, arrest reports state.

Delellis then left the scene, reports state. The incident caused about $500 in damage to the other driver’s vehicle.

A few minutes later, Delellis was accused of attacking an Uber Eats driver who was sitting in her car in a parking lot in the 37000 block of U.S. 19. Reports say Delellis started pounding on the car and trying to stop the driver from rolling her windows up. The Uber driver tried to leave, but Delellis got back into his car and blocked her escape route, reports state.

Delellis at that point got out of his car and started throwing rocks at the woman’s car, reports state. The Uber driver was eventually able to escape.

Delellis was later arrested on charges related to both incidents, though a false imprisonment charge leveled in connection with the Uber Eats incident was dropped by prosecutors earlier this month.

Delellis is awaiting trial on charges of criminal mischief and leaving the scene of a crash in connection with the other incident.

Delellis also has more than 15 traffic infractions in Pinellas County, including multiple citations for careless driving, speeding and following too closely, court records show.
